Review of Fatal Accident Inquiries

SCID welcomed the announcement on the 7th March 2008 by the Secretary for Justice that both he and the Lord Advocate had agreed that there should be a review of the Fatal Accidents and sudden Deaths Inquiry (Scotland) Act 1976. “The intention is that the review will ensure that the legislation is for purpose for the next 30 years, and that it will improve the work that is done in the hugely important and sensitive area, with due regard for the concerns of bereaved relatives.”

Our thanks to the MSPs who added their support to the debate. Many of these MSPs have supported bereaved families in the past.

The review will be carried out by Lord Cullen. As bereaved families know, for the past 10 years we have campaigned for a review in the way FAIs are administered and applied with particular reference to the lack of involvement denied to bereaved families. We presume that there will be a consultation at the end of Lord Cullen’s review.

We would like to receive the views and comments of as many victim families as possible on the subject of FAIs, or is commonly the case, the lack of FAIs. Please let SCID know ASAP so that we can include them in our response to the forthcoming consultation.
